Tierra Austral is a non-profit organization dedicated to protect in perpetuity the ecological, scenic and cultural value of private properties through the use of legal tools or agreements such as a voluntary In Rem Right of Conservation (or Derecho Real de Conservación).
WHAT IS AN IN REM RIGHT OF CONSERVATION (DRC)?
It takes the form of a legally binding and recorded contract between two parties, a landowner, and an NGO, government agency, or individual. In the DRC, the landowner voluntarily constitutes an agreement and establishes certain conditions or restrictions to the real estate for enhancing the conservation of its environmental heritage. Land protected by DRC agreements remains private, and the agreements are drafted to be flexible, in many cases accommodating income-producing sustainable land uses like forestry, agriculture and tourism.
